Terms of Sale

This English translation is provided for convenience. The French version is the legally binding reference.

These terms of sale (the “Terms”) govern the subscription to the OTHGo service and the relationship between the provider and the customer (the “Customer”). By subscribing, the Customer acknowledges having read these Terms and accepts them without reservation.

1. Identification of the provider

In accordance with law no. 18-05 of 10 May 2018 relating to electronic commerce, the e-supplier is identified as follows:

2. Purpose and description of the service

OTHGo is an online service for creating and hosting a showcase website for businesses and professionals. The service includes:

  • the creation of a showcase website in Arabic, English and French from the information provided by the Customer;
  • the publication of the website on a subdomain of the form your-name.othgo.com, with hosting and a security certificate (SSL);
  • the generation of editorial content and visuals assisted by artificial intelligence, which the Customer may review and modify;
  • access to a customer area (editor) allowing the Customer to modify texts, photos, hours and prices, and then republish the website;
  • support by email and by WhatsApp.

The website is provided as a showcase website (presentation of the business); it is not an online sales store and does not include a payment system on behalf of the Customer.

3. Price and payment terms

The service is offered at the price of 25 000 DA per year. This price is understood to be inclusive of all taxes where applicable; the applicable tax regime and the mention of VAT are specified on the invoice issued to the Customer.

Payment is made online, in Algerian dinars, by CIB interbank card or Edahabia card, through our payment service partner SofizPay.

The Customer’s payment card data never passes through OTHGo and is neither collected nor stored by OTHGo: it is processed directly by SofizPay and the interbank system. Payment is due upon subscription and then at each renewal.

An invoice is issued for each payment and made available to the Customer in their customer area.

4. Provision of the service

The provision of the service consists of the effective publication of the website on the assigned subdomain. Publication takes place after validation of the subscription and payment.

The Customer acknowledges that a first version of the website may be generated and previewed before payment, and that publication constitutes the performance of the digital service.

5. Term, renewal and end of the service

The subscription is entered into for a term of one (1) year from the publication of the website. It is renewable for successive periods of one year.

Before the expiry date, the provider sends the Customer reminders by email (for guidance: thirty (30) days, seven (7) days and one (1) day before the expiry date).

In the absence of renewal at the expiry date, the website is first paused (a page indicating the expiry of the subscription replaces the website), and then archived. The Customer’s data is retained for one (1) year after archiving in order to allow the service to be resumed; after this period, it may be deleted.

The Customer may decide not to renew at any time; no renewal is invoiced without a payment being made by the Customer for the following period.

6. Right of withdrawal

In accordance with law no. 18-05 relating to electronic commerce, the consumer Customer has a withdrawal period of fifteen (15) days.

However, the OTHGo service is a digital service whose performance begins as soon as the website is published. Where the Customer has expressly requested and accepted that the service be provided (website published) before the expiry of the withdrawal period, the right of withdrawal may no longer be exercisable for the part of the service already performed.

In practice, the provider deals favourably with any refund request received within fifteen (15) days following payment. Beyond this period, the refund is assessed on a case-by-case basis (in particular in the event of a failure by the provider to provide the service).

To exercise this right or to request a refund, the Customer contacts the provider at the address hello@othgo.com. The refund is made to the same means of payment as that used at the time of subscription.

7. Customer’s obligations

The Customer undertakes to:

  • provide accurate, up-to-date and lawful information;
  • publish only content that is lawful and consistent with public order and morality;
  • hold the necessary rights to the content it provides (texts, photographs, logos, trademarks) and guarantee that it does not infringe the rights of third parties;
  • use the service in accordance with the Algerian regulations in force.

The Customer remains solely responsible for the content it publishes. The provider may suspend a website whose content is manifestly unlawful.

8. Liability and availability

The provider implements reasonable means to ensure the availability of the service. The service is nevertheless provided “as is” and may be subject to interruptions, in particular for maintenance or for causes beyond the provider’s control.

The provider does not guarantee any commercial result (traffic, sales, ranking in search engines). The provider’s liability cannot be engaged for indirect damages; it is in any event limited to the amount paid by the Customer for the current year.

9. Personal data

The processing of personal data is described in our privacy policy, compliant with law no. 18-07 relating to the protection of natural persons in the processing of personal data.

10. Dispute resolution and applicable law

In the event of a dispute, the Customer is invited to first contact the provider in order to seek an amicable solution. The consumer Customer may have recourse to the consumer mediation mechanisms provided for by the regulations.

These Terms are governed by Algerian law. Failing an amicable resolution, the dispute falls within the jurisdiction of the territorially competent Algerian courts.
